Have Lloyds TSB finally admitted they inflict penalties and sanctions?

In a recent statement from a Lloyds TSB Recoveries Team Leader, intended to be used as a witness statement in a claim against them, the witness is quoted as stating:

    1. "For the purposes of this claim only, the Defendant does not intend to contest the claim insofar as it relates to penalty  charges applied against the Claimants' account in the relevant period."

Further on, it is stated:

    1. "It cannot be proper for the Claimants to have carte blanche to operate the account in an irresponsible manner, and to go overdrawn and/or to cause the bank to have to refuse payments, whilst remaining immune from any sanction or from having to compensate the bank."
