Following a success reclaiming from a few High Street Banks I decided to set the ball rolling on an inaccurately defaulted credit card with Capital One Bank (Europe) Plc.


I requested copies of my credit card statement information as well as all other personal data that Capital One held on me by sending them a Subject Access Request (SAR) under the Data Protection Act 1998.


This came through quite quickly (within two weeks) considering the have a statutory 40 days to provide all personal data they held on me as a data subject. I sifted through the statements and worked out that they had levied (charged me) £820 in unlawful penalty charges which they stated were for Late Payment Fees and also Over Limit Fees. I knew full well they were purely a way for the Bank to profit from me as a consumer and this made me more determined to reclaim them back.

I reclaimed mis-sold PPI - Diane's Story. PDF Print

Diane from Cardiff had an existing loan with Nemo Personal Finance, including Payment Protection Insurance and required a further advance. She was provided with a new loan to settle the old one and at this point was mis-sold a new PPI policy.

The financial ombudsman, within his final determination stated "I am not satisfied that a policy that lasted for 5 years of a 25 year loan was a suitable product to sell to Mr and Mrs (Diane), especially as it was not made absolutely clear to them that they would be paying for it over 25 years."

The Office of Fair Trading have released a press release warning consumers about a penalty charge reclaiming scam.  Read on to make sure you do not become a victim of these low life creeps.

So called good value mortgage deals attracting homebuyers into switching providers have been disguising huge administration fees, with some lenders increasing their arrangement fees by more than 600% in the last 24 months.

 

It has been discovered that Banks and Building Societies have simply been misrepresenting their products to score highly in the 'best-buy' tables by appearing to have lower interest rates than their competitors.
